We are Ebiker - Milan Dařina, with registered office at Vysoká Lípa 58, Jetřichovice, 405 02, ID No. 15129322 and we process your personal data as an administrator.

What personal data do we process?

Personal information you provide us

We process personal information that you yourself provide to us.

Third party personal information that you provide to us

If you provide us with personal data of third parties, it is your responsibility to inform the persons concerned and ensure that they agree to these terms of privacy.

Camera systems on our premises

We also automatically process camera recordings at our facility.

Our facility is monitored by a camera system with online transmission and recording. We have cameras on the premises both for prevention and for clarification of possible illegal activities. The operator of the camera system is us, Ebiker - Milan Dařina, ID No. 15129322.

Why do we collect and process your personal data?

We process your personal data for the following reasons:

  • Purchase of goods and services: First of all, we process your personal data to properly process your order. If there are any problems, we know who we can contact with your personal information.
  • Customer Care: If you turn to us with a question/ problem, we need to process your data to answer/ resolve it.
  • User Account: A number of useful features will be made available to you through the personal information you provide in your user profile (for example, if you include your phone number, we can easily inform you when your order will be delivered). You can change the information you enter at any time, with the exception of the email address used to access your user account.
  • Enforcement of rights and legal rights and control of public authorities: We may also process your personal data because we need it to exercise our rights and legal rights (e.g. if there is an outstanding claim/ payment). We may also process your personal data for the reason that we need it for the purposes of controls performed by public authorities and other similarly serious reasons.

We process personal data on these legal bases

Performance and conclusion of the Agreement

We need a great deal of your personal data to be able to enter into a purchase or other contract with you for the goods or services you want to buy from us. Once the contract is concluded, we process your personal data to properly provide the services you have purchased. For this legal reason, we process mainly billing and delivery data.

Transfer of personal data to third parties

  • Credit Cards: Our company does not have information of the credit card you pay with us. Your credit card information is only available to the appropriate banking institution.
  • Government: In the case of enforcing our rights, your personal data may be passed on to a third party (e.g. a lawyer). If the legal order, or a state authority (e.g. the Police of the Czech Republic) imposes an obligation on us to pass on your personal data, we must do so.

How long have we been processing your personal data?

First of all, we will process your data for the entire duration of the contractual relationship between us.

In the case of processing of personal data for which consent has been given, your personal data will generally be processed for 7 years, or until such consent is revoked.

Please also note that the personal data that are necessary for the proper provision of services, or in order to fulfil all our obligations, whether these obligations arise from the Agreement between us or from generally binding legal regulations, we must process such data, regardless of your consent, for a period set by or in accordance with applicable legal regulations (e.g. for tax documents this period is at least 10 years).

We process data obtained through a user account or other similar method during the period of use of our services and usually 5 years after their cancellation.

By default, we save the camera recordings for 90 days. If an unlawful conduct occurs in the monitored area, we can contact the police and hand over the relevant records to the competent authority (police, court, etc.). In this case, the records are not deleted after 90 days, but for evidence reasons we keep them until the case has come to a definitive end and final court resolution.

Security of personal data

Your personal information is safe with us. In order to prevent unauthorized access and misuse of your personal data, we have put in place appropriate technical and organizational measures. All passwords are encrypted with one-way encryption, so it is not possible to send a forgotten password. Use the Forgotten Password form to reset your password.

What rights do you have regarding the protection of your personal data?

In particular, in relation to your personal data, you have the right to withdraw your consent to the processing of personal data at any time, the right to correct or supplement your personal data, the right to request processing limitations, the right to object to or complain against your personal data processing, the right to have access to your personal data, the right to request the transfer of your personal data, the right to be informed of a breach of the security of your personal data, and, under certain conditions, the right to have certain personal data we process in relation to you (the "right to be forgotten") be deleted.

Modifications and supplementing your personal data

You control your personal information primarily through your user account.

Correction

You can make corrections to your personal information in your user profile.

Pursuant to the amendment to Act No. 235/2004 Coll., On Value Added Tax, it is not possible to change data in an already issued invoice as of 1 January 2013. The invoice information can only be changed if you have not yet received and paid for the goods.

Deletion

You may request that information about you be deleted (but the deletion will not affect data on documents that we are legally required to retain (such as invoices or credit notes). If we need your personal information to determine, enforce or defend our legal claims, your application may be rejected (e.g. if we have an outstanding claim against you).

Please note that key information about your credit card is not stored with our company, but with our contractual bank. Therefore, this data cannot be deleted from us and it is necessary to contact the bank through which you made the payment (see the chapter Third Parties > Transfer of Data > Payment cards).

Except as provided above, you have the right to be deleted in the following cases:

  1. Personal data are no longer needed for the purposes for which they were processed
  2. You have withdrawn your consent for the data to be processed and there is no other legal reason for the processing
  3. You disputed the processing of the personal data, and you believe that the dispute assessment will reveal that in a particular situation your interest outweighs our interest in processing of these personal data
  4. Personal data are processed unlawfully
  5. The obligation to delete is laid down in a special legal regulation
  6. This concerns personal data of children under 16 years of age

Objection

We process some of your personal information based on our legitimate interest (see the section on these terms entitled “We process personal information on these legal bases”). If there are specific reasons on your part, you may object to the processing of your personal data. You can raise this objection at info@rent-your-ebike.cz

Filing a complaint

If you believe that we are processing your personal data unlawfully, you also have the right to file a complaint with the Office for Personal Data Protection.
